The Trend Drawer ("we", "us", "our") operates the online store at thetrenddrawer.com (the "Store"). The Store is operated by Ryan Schokman trading as The Trend Drawer, ABN 28 256 080 722, based in Queensland.
This Privacy Policy explains how we collect, use, disclose and protect your personal information when you visit or buy from the Store, or otherwise communicate with us. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us. By using the Store you agree to the handling of your information as described in this policy.
1. What personal information we collect
Information you give us directly
- Contact details: name, email address, phone number, delivery and billing address.
- Order details: products purchased, order history, return and refund requests.
- Account details (if you create an account): username, password and preferences.
- Messages you send us, including customer support emails and reviews.
- Marketing preferences, such as whether you have subscribed to our emails.
Payment information. Payments are processed by our payment providers (such as Shopify Payments, PayPal or other providers shown at checkout). We do not see or store your full card number.
Information collected automatically. When you use the Store, we and our service providers use cookies, pixels and similar technologies to collect device and usage information, such as your IP address, browser type, pages viewed, how you got to the Store and how you interact with it.
Information from third parties. We may receive information about you from:
- Shopify, which powers the Store, and our payment processors;
- our suppliers and delivery carriers (for example, tracking and delivery status);
- social media and advertising platforms (for example TikTok, Instagram and Facebook) if you interact with our content or ads, in line with your settings on those platforms.
We collect only the information we reasonably need for the purposes below. You can browse the Store without giving us your name, but we need certain details to fulfil an order.
2. How we use your personal information
We use your personal information to:
- process and deliver your orders, including sending order confirmations, invoices and tracking updates;
- handle returns, refunds, warranty and Australian Consumer Law claims;
- respond to your questions and provide customer support;
- send you marketing emails or messages, only where you have agreed (you can unsubscribe at any time using the link in each email, as required by the Spam Act 2003 (Cth));
- show you relevant ads on other websites and social platforms, and measure how our ads perform;
- maintain, secure and improve the Store, and detect and prevent fraud;
- comply with our legal obligations, including tax and consumer laws.
3. How we disclose personal information
We share personal information only as needed for the purposes above, including with:
- Shopify (our e-commerce platform) and other service providers who host the Store, process payments, send emails or provide analytics;
- suppliers and fulfilment partners who pack and ship your order. Many of our products are shipped directly from overseas suppliers, so your name, delivery address, phone number and order details are shared with them so they can deliver your parcel;
- delivery carriers and customs authorities in Australia and overseas;
- advertising and social media partners, for example to measure ads or show you relevant ads;
- professional advisers, and law enforcement or regulators where required or authorised by law;
- a buyer or successor if our business is sold or restructured.
We do not sell your personal information.
4. Overseas disclosure
Some of the organisations we share information with are located, or store data, outside Australia. This includes our suppliers and fulfilment partners in China, and service providers (such as Shopify, payment processors and advertising platforms) that may store data in Canada, the United States, Europe and other countries. We take reasonable steps to make sure these recipients handle your information in a way that is consistent with the APPs.
5. Cookies
The Store uses cookies to keep it working (for example, remembering your cart), to understand how the Store is used, and for advertising. You can control cookies through your browser settings and, where available, our cookie banner. Blocking some cookies may stop parts of the Store from working.
6. Third-party websites and links
The Store may link to other websites or platforms (for example, our social media pages or a carrier's tracking page). We are not responsible for their privacy practices, and we encourage you to read their privacy policies.
7. Children
The Store is not directed at children, and we do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, please contact us and we will delete it.
8. Security and retention
We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
We keep personal information only for as long as we need it for the purposes above, including to meet legal, tax and accounting requirements (for example, keeping transaction records for at least 5 years). When we no longer need it, we take reasonable steps to delete or de-identify it.
If a data breach is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) where required by the Notifiable Data Breaches scheme.
9. Access, correction and your choices
You can ask us to access or correct the personal information we hold about you by emailing thetrenddrawer@gmail.com. We will respond within a reasonable time (usually within 30 days). We may need to verify your identity first. If we refuse a request, we will tell you why.
You can unsubscribe from marketing at any time. You can also ask us to delete your information, and we will do so unless we need to keep it for legal reasons (for example, order and tax records).
You may deal with us anonymously or using a pseudonym where that is practical, but we cannot process an order without your name and delivery details.
10. Complaints
If you have a concern about how we have handled your personal information, please contact us first at thetrenddrawer@gmail.com and we will try to resolve it within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
11. Changes to this policy
We may update this Privacy Policy from time to time, for example to reflect changes to our practices or the law. We will post the updated version on this page and change the "Last updated" date.
