Overview
This website is operated by Ryan Schokman, ABN 28 256 080 722, trading as The Trend Drawer ("we", "us", "our"). We offer this website, including all information, tools and services available from it (the "Store"), to you on the condition that you accept these Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and Shipping policy, which form part of these Terms.
By visiting the Store or buying from us, you agree to these Terms. If you do not agree, please do not use the Store.
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law that cannot lawfully be excluded or limited. If any part of these Terms would do that, it applies only to the extent permitted by law.
The Store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.
1. Using the Store
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using the Store with the involvement and consent of a parent or guardian.
You must not use our products or the Store for any illegal or unauthorised purpose, or in a way that breaches any law. You must not transmit any viruses or code of a destructive nature.
2. General conditions
We may refuse service to anyone for any lawful reason at any time.
Your content (not including card details) may be transferred unencrypted over networks and adapted to technical requirements. Card details are always encrypted during transfer by our payment providers.
You agree not to reproduce, copy, sell or exploit any part of the Store, its content or its images without our written permission.
3. Accuracy of information
We try to make sure the information in the Store is accurate and up to date, but it is provided for general information only. Product images are for illustration; colours, shapes and packaging may vary slightly between batches. Where a variation is significant, your rights under the ACL apply.
4. Changes to the Store and prices
Prices are in Australian dollars (AUD). Prices may change without notice, but the price you pay is the price shown at checkout when you place your order.
We may change or discontinue products or parts of the Store at any time.
5. Products
Some products are available online only and in limited quantities. Our products are shipped directly from overseas suppliers, and estimated delivery is 10 to 20 business days after dispatch (see our Shipping page). Delivery times are estimates, not guarantees.
Products are intended for normal household use as described on the product page. Please read and follow any care, safety, age and supervision instructions supplied with the product.
6. Orders, billing and account information
When you place an order, you are making an offer to buy. A contract is formed when we accept your order, which happens when we confirm dispatch, or earlier if we tell you so.
We may refuse or cancel an order, for example if a product is unavailable, if there is an obvious pricing error, or if we suspect fraud. If we cancel an order after payment, we will refund you in full.
You agree to provide current, complete and accurate purchase and account information, and to keep it up to date so we can complete your order and contact you.
For returns and refunds, please see our Refund Policy.
7. Optional tools
We may give you access to third-party tools that we do not monitor or control. These tools are provided "as is" and your use of them is at your own discretion, subject to the terms of the relevant third-party provider and to your rights under the ACL.
8. Third-party links
Some content or services in the Store may come from third parties or link to third-party websites. We are not responsible for third-party content, products or services, and you should review their terms and policies before using them.
9. Reviews, comments and feedback
If you send us reviews, comments, ideas or other material, you grant us a non-exclusive, royalty-free licence to use, edit, publish and reproduce it in connection with the Store. You agree that your comments will not be unlawful, misleading, defamatory, or infringe anyone else's rights. We may remove content we consider unlawful or offensive. We do not publish fake reviews or edit reviews to change their meaning.
10. Personal information
Your submission of personal information through the Store is governed by our Privacy Policy.
11. Errors and omissions
Occasionally there may be errors in the Store relating to product descriptions, pricing, promotions, shipping charges or availability. We may correct errors and update information at any time. If an error affects an order you have placed, we will contact you and you can choose to continue at the corrected price or cancel for a full refund.
12. Prohibited uses
You must not use the Store to: break any law; infringe our or anyone else's intellectual property; harass, abuse, defame or discriminate; submit false or misleading information; upload malicious code; collect other people's personal information; spam, phish or scrape; or interfere with the security of the Store. We may suspend your use of the Store if you breach this section.
13. Consumer guarantees and limitation of liability
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Subject to your rights under the ACL and any other law that cannot be excluded:
- we do not guarantee that the Store will be uninterrupted, timely, secure or error-free;
- where our liability for failure to comply with a consumer guarantee can lawfully be limited (for example, for goods not of a kind ordinarily acquired for personal, domestic or household use), it is limited to replacing or repairing the goods, or paying the cost of doing so; and
- we are not liable for loss that was not reasonably foreseeable, or that was caused by your misuse of a product or failure to follow its instructions.
14. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be read down or severed, and the rest of these Terms will continue to apply.
15. Termination
These Terms apply until terminated by you or us. You can stop using the Store at any time. We may suspend or end your access if you breach these Terms. Any obligations and rights that arose before termination (including your ACL rights) continue.
16. Entire agreement
These Terms, together with the policies referred to above, are the entire agreement between you and us about your use of the Store.
17. Governing law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland. This does not prevent you from relying on consumer protection laws of the state or territory where you live.
18. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page. The version that applies to your order is the one published when you placed it.
